TSR Leeches: Still trying to claim EA owned content as their own.

Oh dear, this is about the most contradictory tripe I have heard from TSR in a long time.

Dear Flow,

All the Sims rights DO belong to EA, we know that because we have taken the time to read the EULA, this is something you yourself should try to make time to do, so that in the future you could avoid breaking the law by illegally selling EA owned products on the pirate site, TSR. You seem very concerned that people should not USE  anything created by someone else and especially not SHARE them and yet YOU are using EA owned products, manipulating and selling them on a website in direct violation of the EULA. Even more disturbing is the fact that even though you are selling these products which do not legally belong to you you still state that no one can actually use them? ( although I do concede that in some cases, TSR CC is somewhat unusable )

“Even if it’s made by EA workers or not?” The sims and all it’s contents WERE made by EA workers, and  EA gives us fully transferable worldwide permission to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit or otherwise communicate to the public by any means without further compensation to you of any kind. It is laughable that you think you own this content even though you admit it was made by EA workers and, in addition, you think you have the right to steal it, sell it and overrule their usage permissions.

When you boot up the Sims you agree to the EULA which states:  You hereby waive any moral rights of paternity, publication, reputation, or attribution with respect to EA’s and other players’ use and enjoyment of such assets in connection with the software and related goods and services under applicable law.

So in short YOU have no rights on content that does not belong to you, it is perfectly legal for you to upload it to TSR as EA have given you and every other player permission to do so, it is however illegal for you to sell it.  Baixe Sims has full permission from EA via the EULA to host this content, if you don’t like it, I suggest you spend a few years making your own game and only then will you have the right to call a multi million best selling game your own – or is that too much hard work for you?

TSRFree returns with a new site and name :)

Popular Brazilian site  TSRfree has returned with a cool new site and name, now known as DownloadSims/Baixe-sims

As many of you will know, like SunsetSims, TSRFree has suffered the same abuse and unwarrented DMCA reports from TSR, which resulted in the closure of their fantastic site. I would like to give them a big welcome back to the community and wish them the best with the new site.

Downloadsims offers TSR subscription downloads for FREE and takes requests. This is perfectly legal and in compliance with EA’s EULA.

“In exchange for the use of the software, and to the extent that your contributions through the use of the software give rise to any copywrite interest, you hereby grant EA an exclusive, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and licence to use your contributions in any way and for any purpose in connection with the software and related good and services including the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of protection granted to intellectual property rights by applicable laws and international conventions. You hereby waive any moral rights of paternity, publication, reputation, or attribution with respect to EA’s and other players’ use and enjoyment of such assets in connection with the software and related goods and services under applicable law. Sunsetsims will be taking a short personal break from uploading/requests. This is only temporary and sunset stresses that she will be back very soon. We all will be missing her already and cannot wait to have her back.

Sunsets downtime, hacking and recent events. Full disclosure. UPDATED FEB 25

  As most of you will know, Sunsetsims had been down for some time before the recent hacking.  As far as we know this was due to server issues caused by the server being unable to cope with the large volume of visits Sunsetsims attracts. Sunset will be resolving these issues shortly and the downtime is only temporary.  Users can still get updates/requests  —>HERE<—  ( Link updated )

  On 3rd Feb, even though the site was down,  SunsetSims was hacked, a large number of files were deleted, including downloads and wordpress files.  Config files were backed up and downloaded by the hacker  and a new index file containing a redirect to TSR was uploaded.  The server host, Pescado was contacted for any assistance he may be able to give.  Basically there was nothing left of the site to salvage, so it was just a case of him securing the site and providing any information that may help identify the hacker.  

  It struck me as unusual  that TSR would attack a site that was already down, in fact VERY unusual was the fact that they did not hack it while it was up and still a threat to them. How did they even know the site was accessible in its current state? Why did they back up the WP config? Sunset is the only admin, and they clearly had her password already, so unless they were planning on restoring the site structure I could not figure out their endgame. Also unusual was TSR doing a redirect directly to their own doorstep…  But  hey, this is TSR and they do not always play by the book.

  Pescado checked the FTP logs, and as the site had been down for so long only one IP had recently logged in, and this did not belong to Sunset. This IP was logged as entering the site at around the time of the hack, spending 2 and a half hours deleting files, backing up the config file and uploading a new index file that contained the redirect to TSR. This was the ONLY IP to have logged in on that day, or in any of the days before the attack. No other IP logged in after this. The IP was 121.45.48.168

  I traced the IP back to Australia and I was interested to see it was NOT a proxy, I started checking through my old message logs, working on the theory this was someone trying to frame TSR, and so may be on THIS side of the fence. I have never wanted to be more wrong, but I was not prepared to issue an article stating that TSR hacked Sunset when I had doubts that this was true. I found a few matches in my shoutbox from someone with an obvious beef against Pescado urging Sunset to leave Pescado’s hosting and set up with a better host ( and other general anti-Pescado remarks ) We now had a motive for the attack, but unfortunately not a ‘who’ as the poster posted under several generic names, none of which was recognizable as a ‘genuine’ community member. While I was searching through old post and comment IPs, another shout was posted by the same IP as the hacker:

  So, the hacker could add impersonation to his ‘talents’ Shane AKA Shan0w AKA Shane_Gowland is known to the community as a pillar of society, he has been a victim himself of a nasty TSR hack, I assisted him as much as I could at the time, and in return he has assisted me. He has also spent time trying to help Sunset, she gave him her FTP pass to her site, although he was unable to fix any problems,  she was very grateful for the time and effort he spent in there trying. His knowledge of word press and websites in general is good and we valued Shane as a good friend and ally. He is an all round nice guy and I was really annoyed that this scumbag hacker would be using Shanes good name to agree with his own nasty posts, especially as the real Shane had been so kind as to write to Sunset immediately after the hack and offer his assistance. Luckily I have many examples of the real Shanes IP, so it would be easy for me to discount the ‘imposter’ . Sadly, all I found was that both the ‘imposter’ and the hacker were in fact the real Shane. Shane uses 3 IP bands, one of these, the one he uses the most, is a match to sunsets hacker and the poster. ( the others being dynamics of example IPs 118.210.241.29 and 99.198.122.79 )

TSR attacks 3 more sites with false DMCA Reports UPDATED

TSR scumbag Thomas O. Isaksson has attacked 2 more Sims sites with his false DMCA reports. TSR have NO RIGHT to report any files for a DMCA as legally TSR own nothing. The EULA clearly states that all files made using EA owned software ( The Sims ) is the property of EA GAMES. EA games have given open permission for fansites to publish and/or share THEIR property for other players enjoyment – unless it is for commercial gain ( as in illegally selling it @TSR ) Even the TSR workshop was created using the EA software, which means that too remains the property of EA.

Not happy with falsely reporting EA owned files made by current TSR staff, Tom has stooped low enough to report retextures of files made by FORMER TSR staff that are not even on TSR, in this case Newsea. Also reported were files made solely by the site owners which have no connection to TSR’s present or former staff.

Jenni from Jennisims has also had several take down notices on files where both the meshes and the textures were entirely created by Jenni. One example is this:

 It is also worth noting that all Jennis downloads are her own work, on occasions where she has used outside meshes, these are not included in the download – only the re-textures made by herself.

Tom, yesterday, made a somewhat correct statement stating that someone with nothing better to do is reporting Mediafire files. He also claims that anyone can put his name on the complaint, also true.. But how the hell does he explain ’them’ using his email to file the complaints? Oh that’s right.. he doesn’t! He also fails to explain why he has not cancelled the claims. Mediafire would notify him, at his given contact address, that the files are being suspended, he would know even before the file owner does, so why did he not simply write to Mediafire and admit the files do not belong to him or TSR? Instead he waits until the file owner contacts him and then fakes mock shock and horror, he seems to be feeding off their confused emails, rather like last April when he pulled the same ‘joke’ for an April fools stunt. It is a criminal offence to file a fake DMCA report, Tom knows this. He needs the ‘genuine’ reports to get the files removed, but he thinks he is being smart using the half hearted denials ( that really are not denials ) after the fact to wriggle out of legal action.. Tom isn’t as smart as he he thinks he is - and the community are not so dumb.

Dandangate:EA Mole – UPDATE

An update to EA mole story linked above.

The person who did write the complaint to EA, and had her info shared with TSR by EA Mole Sherrie Dandan has now decided to take legal action.

I wish this person every success with this action. When you make a complaint to EA, you expect it to be confidential as any private Email should be, you DO NOT expect it to be forwarded on to the very company ( an illegal company known for hacking and information sharing ) that you complained about along with your personal info and for it to be ridiculed and smeared with false accusations. EA and Sherrie Dandan need to answer for this and a court room is an ideal place to start.

EA Clarifies the EULA!

Yes, TSR this applies to YOU!

For Steve and Thomas, who have always purposely had trouble understanding the meaning of the EULA..

This says that greedy businesses such as  TSR have waived any legal or moral rights to their ‘contributions’ and that EA and OTHER PLAYERS can publish, attribute or use these downloads without further notice or compensation to TSR or any other paysite.

For everyone else

You finally have the clarity from EA that you have been waiting for, so if you re-publish a ‘contribution’ from TSR, and you get the usual take down notices from places such as Mediafire or your webhost, just reply with a copy of the EA EULA PDF and a screencap and/or directions to the relevent part. ( PDF page 3, Part G ) You could also include a link to or a copy of this EULA on your site so that there are no misunderstandings.

Racist paysite CATcrap shares donators personal information. UPDATED 2 NOV

Not TSR related, however this lowlife bottom feeder CATcorp seems to have all the credentials necessary to join the pond life over at TSR.

This began when the popular freesite Sunset Sims posted a ‘leaked’ payfile from the desperate Russian paysite, CATcorp. CATcorp reacted in a fashion that would make any TSR groupie proud  - She illegally posted the IP, full name, full home address and E-mail address of a random paypal donator. Twice. If that is not shocking enough here’s the reason why..  Sunset sims is a Spanish site, so CATcorp has now decided that the entire Spanish community are all ‘thieves’. The donator to this small time paysite is also Spanish, and even though this person was kind enough to give CATcorp money, she took the money and posted her PRIVATE info and labelled her a ‘thief’ simply because she is Spanish.  YES, you read that right, she was named and shamed as a thief solely because she has the same nationality as the free site Sunsetsims! This is absolutely disgusting and racist to the core. CATcorp has also banned anyone who is Spanish from using her downloads.

Anyone donating money to CATcorp should think again.  If you are not Spanish you may think that this does not affect you, but what if a site from the US/UK/AUS/Asia posts one of her downloads? You would be wrongly labelled as a thief if you share a nationality with any site she takes a dislike to and it could be your private details up on her site next.

New TSR Malware Warning: UPDATED
